EU/Morocco fisheries agreement challenged

MEPs Joao Ferreira (Portugal) and Willy Meyer (Spain), both members of the EUL/NGL group, have requested the annulment and revision of the EU’s fisheries agreement with Morocco, alleging that it is «illegal». Based on a report by Parliament’s legal division debated by the EP Fisheries Committee on 23 February, Ferreira and Meyer conclude that the agreement is not in conformity with international law. «We were always opposed to this agreement because it considers the waters of the Western Sahara to be Moroccan, which means recognition of the Western Sahara by Morocco and makes the EU an instrument of this occupation,» they declared. The agreement does not comply with international law and the legitimate rights of the Saharawi people, they continue, because, according to the United Nations, Morocco has no sovereignty over the Western Sahara or its natural resources. In 2006, the EUL/NGL tabled proposals to amend the agreement so as to bring it into line with international law and exclude the waters of the Western Sahara by restricting it to waters north of latitude 27 º 40 ‘N. Despite its non-conformity, the fisheries agreement entered into force on 28 February 2007.
