ACTA: Commission adopts submission to court

On 4 April, the European Commission adopted a formal decision to seek an opinion from the EU Court of Justice on the conformity of the Anti-Counterfeiting Trade Agreement (ACTA) with EU law. The submission (a legal act) will be presented to the court in the coming weeks. The question that will be submitted is as follows: “Is the Anti-Counterfeiting Trade Agreement compatible with the European treaties, in particular with the Charter of Fundamental Rights of the European Union?” The Commission chose a sufficiently broad legal question to allow the court to conduct a detailed review of the different aspects, which include freedom of speech and information, data protection and intellectual property rights.
