The Belgian electricity and gas regulation commission (CREG) initiated, on 20 June, an action for annulment before the Belgian Constitutional Court. The case concerns certain provisions of the law of 8 January 2012 that transposes into Belgian legislation the EU’s third energy liberalisation package. The CREG will also lodge, “in the coming days,” a complaint with the European Commission. The Belgian regulator challenges the work of the government and federal parliament. It wishes to prevent a situation of legal uncertainty causing confusion if the courts should decide to annul its recent decisions on gas and electricity transmission rates in Belgium.
